Summary Statement of Deficiencies D2016 SUCCESSFUL PARTICIPATION CFR(s): 493.803(a)(b)(c) (a) Each laboratory performing nonwaived testing must successfully participate in a proficiency testing program approved by CMS, if applicable, as described in subpart I of this part for each specialty, subspecialty, and analyte or test in which the laboratory is certified under CLIA. (b) Except as specified in paragraph (c) of this section, if a laboratory fails to participate successfully in proficiency testing for a given specialty, subspecialty, analyte or test, as defined in this section, or fails to take remedial action when an individual fails gynecologic cytology, CMS imposes sanctions, as specified in subpart R of this part. (c) If a laboratory fails to perform successfully in a CMS- approved proficiency testing program, for the initial unsuccessful performance, CMS may direct the laboratory to undertake training of its personnel or to obtain technical assistance, or both, rather than imposing alternative or principle sanctions except when one or more of the following conditions exists: (1) There is immediate jeopardy to patient health and safety. (2) The laboratory fails to provide CMS or a CMS agent with satisfactory evidence that it has taken steps to correct the problem identified by the unsuccessful proficiency testing performance. (3) The laboratory has a poor compliance history. This CONDITION is not met as evidenced by: During a proficiency test desk review performed on 03/04/2022, based on review of CASPER report 155D and graded reports from American Proficiency Institute (API), it was determined that the laboratory failed to successfully participate in proficiency testing for the specialty of chemistry, the analyte creatine kinase (CK) for two of three consecutive events reviewed (2021, Events 1 and 3), See D2087 and D2096. The laboratory also failed to successfully participate in proficiency testing for the specialty of hematology, the analyte cell ID, and hemoglobin (Hgb), red blood cell (RBC), Statement of Deficiencies (X1) Provider/Supplier/CLIA Identification Number (X3) Date Survey Completed Name of Provider or Supplier Street Address, City, State -- 1 of 3 -- hematocrit (Hct), white blood cell (WBC) and platelets (Plt) for two of three consecutive proficiency testing events reviewed (2020, Event 3 and 2021, Event 1). See D2087 and D2121 D2087 ROUTINE CHEMISTRY CFR(s): 493.841(a) Failure to attain a score of at least 80 percent of acceptable responses for each analyte in each testing event is unsatisfactory analyte performance for the testing event. This STANDARD is not met as evidenced by: During a PT desk review performed on 03/04/2022, based on review of CASPER report 155D and graded reports from API, the laboratory failed to successfully participate in proficiency testing for the specialty of chemistry, the analyte creatine kinase (CK) for two of three consecutive proficiency testing events reviewed (2021, Events 1 and 3) Findings include: 1. Review of the CASPER report 155D revealed the following proficiency test scores: a. 2021, Event 1: chemistry: 0%, CK: 0% b. 2021, Event 3: chemistry: 0%, CK: 0% 2. The above event scores were confirmed upon review of the graded report from API. Scores less than 80% for this analyte indicates unsatisfactory performance. A failure of this analyte for two consecutive or two out of three consecutive testing events is scored as unsuccessful. D2096 ROUTINE CHEMISTRY CFR(s): 493.841(f) Failure to achieve satisfactory performance for the same analyte or test in two consecutive testing events or two out of three consecutive testing events is unsuccessful performance. This STANDARD is not met as evidenced by: During a proficiency testing desk review performed on 03/04/2022, based on review of the CASPER 155D report and graded report from API, it was determined that the laboratory failed to achieve satisfactory performance for failed to successfully participate in proficiency testing for the specialty of chemistry, the analyte creatine kinase (CK), for two of three consecutive proficiency testing events reviewed (2021, Events 1 and 3). D2121 HEMATOLOGY CFR(s): 493.851(a) Failure to attain a score of at least 80 percent of acceptable responses for each analyte in each testing event is unsatisfactory analyte performance for the testing event. This STANDARD is not met as evidenced by: During a proficiency testing desk review performed on 03/04/2022, based on review of the CASPER report 155D and laboratory proficiency testing records (graded copies from API), it was determined that the laboratory failed to attain a score of at least 80 percent in proficiency testing for the specialty of hematology, the analyte cell ID, and hemoglobin (Hgb), red blood cell (RBC), hematocrit (Hct), white blood cell (WBC) and platelets (Plt) for two of three consecutive proficiency testing events reviewed -- 2 of 3 -- (2020, Event 3 and 2021, Event 1). The findings include: 1. Summary Statement of Deficiencies D5809 TEST REPORT CFR(s): 493.1291(e) The laboratory must, upon request, make available to clients a list of test methods employed by the laboratory and, as applicable, the performance specifications established or verified as specified in 493.1253. In addition, information that may affect the interpretation of test results, for example test interferences, must be provided upon request. Pertinent updates on testing information must be provided to clients whenever changes occur that affect the test results or interpretation of test results. This STANDARD is not met as evidenced by: During an onsite recertification survey on 2/28/2018, based on the NanoEntek FREND Prostate Specific Antigen (PSA) Plus package insert review and patient record review, the laboratory failed to include on the PSA test report the method of testing used as information that may affect the interpretation of test results for 3 random patient charts reviewed from 2017 and 2018. Findings include: 1. The laboratory started testing on the NanoEntek FREND analyzer in June 2016. 2. The Nanoentek FREND PSA Plus test manufacturer's package insert stated that results reported must inlcude the identity of the assay used, as PSA testing values vary among methods and cannot be used interchangeably to monitor PSA levels. 3. Random review of patients' charts revealed that the PSA assay used was not included on the following reports: a. Patient 14309, reported 12/29/2017 b. Patient 15365, reported 2/2/2018 c. Patient 15895, reported 2/16/2018 4. The laboratory failed to include the identity of the PSA method used on the test report, as required.
