(b) Except as specified in paragraph (c) of this section, if a laboratory fails to participate successfully in proficiency testing for a given specialty, subspecialty, analyte or test, as defined in this section, or fails to take remedial action when an individual fails gynecologic cytology, CMS imposes sanctions, as specified in subpart R of this part. (c) If a laboratory fails to perform successfully in a CMS- approved proficiency testing program, for the initial unsuccessful performance, CMS may direct the laboratory to undertake training of its personnel or to obtain technical assistance, or both, rather than imposing alternative or principle sanctions except when one or more of the following conditions exists: (1) There is immediate jeopardy to patient health and safety. (2) The laboratory fails to provide CMS or a CMS agent with satisfactory evidence that it has taken steps to correct the problem identified by the unsuccessful proficiency testing performance. (3) The laboratory has a poor compliance history. Summary Statement of Deficiencies D5413 TEST SYSTEMS, EQUIPMENT, INSTRUMENTS, REAGENT CFR(s): 493.1252(b) The laboratory must define criteria for those conditions that are essential for proper storage of reagents and specimens, accurate and reliable test system operation, and test result reporting. The criteria must be consistent with the manufacturer's instructions, if provided. These conditions must be monitored and documented and, if applicable, include the following: (1) Water quality. (2) Temperature. (3) Humidity. (4) Protection of equipment and instruments from fluctuations and interruptions in electrical current that adversely affect patient test results and test reports. This STANDARD is not met as evidenced by: D5413 Based on the review of manufacturer requirement for chemistry analyzer ACE Axcel Alfa Wassermann and AIA 900 Tosoh BioScience, the laboratory failed to monitor humidity, and establish humidity ranges for the analyzer. Finding: 1. As per user manual of chemistry analyzer ACE Axcel Alfa Wassermann, the manufacturer requirement of humidity range is 20-80% and AIA 900 Tosoh BioScience manufacturer requirement of humidity range is 40-80%. 2. No humidity records were available for review at survey. 3. Confirmed on an interview with laboratory supervisor on 4/7/2022 approximately 1:30pm. Summary Statement of Deficiencies D5641 CYTOLOGY CFR(s): 493.1274(d)(2)(ii) (d) Workload limits. The laboratory must establish and follow written policies and procedures that ensure the following: (d)(2)(ii) For the purposes of establishing workload limits for individuals examining slides in less than an 8-hour workday (includes full-time employees with duties other than slide examination and part-time employees), a period of 8 hours is used to prorate the number of slides that may be examined. The formula-- Number of hours examining slides X 100 / 8 is used to determine maximum slide volume to be examined; This STANDARD is not met as evidenced by: Based on surveyor's review of laboratory records and confirmed in an interview with the pathologist/laboratory director/technical supervisor and the laboratory supervisor, the laboratory failed to establish and follow a procedure to pro-rate the number of slides that may be examined each day, to ensure that the individual examining non- gynecologic slides would not exceed the maximum number of slides to be examined when examining cytology slides in less than eight hours. Findings: 1. On September 19, 2018 at approximately 12:00 PM the laboratory director/technical supervisor and the laboratory supervisor confirmed surveyor's findings that on February 4, 2018 the individual examining non-gynecologic cytology slides examined 53 cytology cases. The Daily Slide Case Review log did not include the start time, end time and total # of hours to read the 53 cytology cases on February 4, 2018. 2. The laboratory has one cytotechnologist indicated on the CMS 209 Laboratory Personnel Form by the initials MH, who is the primary individual examining of non-gynecologic cytology slides. The initial of the individual examined 53 cytology slides on February 4, 2018 was BC. The pathologist/laboratory director/technical supervisor and the laboratory supervisor were unable to identify the individual by the initial BC who examined 53 cytology slides on February 4, 2018.
