Summary Statement of Deficiencies D6046 TECHNICAL CONSULTANT RESPONSIBILITIES CFR(s): 493.1413(b)(8) (b) The technical consultant is responsible for-- (b)(8) Evaluating the competency of all testing personnel and assuring that the staff maintain their competency to perform test procedures and report test results promptly, accurately and proficiently. This STANDARD is not met as evidenced by: Based on review of testing personnel listed on the CMS-209, review of testing personnel initial competencies, and interview with the Director of Operations, not listed on CMS-209, the laboratory failed to have the technical consultant perform competencies on personnel performing moderate complexity testing. Findings are: 1. Review of the CMS-209 personnel form presented by the laboratory at the time of survey on 10/1/2020 revealed three testing personnel performing moderate complexity testing. 2. Review of initial competencies for the three testing personnel revealed a testing personnel had signed off on the competency forms. The person performing competencies did not qualify as a technical consultant. 3. Interview with the Director of Operations, not listed on CMS-209, on 10/1/2020 at 11:35 AM revealed the technical consultant did not perform competencies on the three testing personnel performing moderate complexity testing.
